A foreign employee's right to work in China is tied to the employer, the position and the approved permit. When one of those elements changes, the employee may need a new permit or a formal amendment before starting the new arrangement.

When a change is triggered

  • Moving to a different legal entity, including an affiliate or a new WFOE.
  • A significant change of job title, duties or work location.
  • A change in the employee's permit category or qualifying credentials.
  • Renewal after the permit or residence permit expires.

A secondment from an overseas group company needs particular care. The local entity, the overseas employer and the employee should document who pays the salary, who directs the work and which entity holds the permit.

The usual sequence

  1. Confirm the new employer's registration and the role's eligibility.
  2. Prepare the new employment contract and supporting documents.
  3. Apply for the work permit change or new permit through the relevant authority.
  4. Complete the residence permit update after the work permit is approved.
  5. Keep the employee's tax and social insurance position consistent with the new arrangement.

The employee should not start work for the new employer before the required approval. A gap between employers can affect the residence permit, so plan the timing rather than resigning first and applying later.

Practical risks

Working outside the approved scope can expose both the company and the individual to penalties and can affect future applications. Salary, title and employer details should match across the contract, the permit application and the tax filings. If the role changes but the permit does not, the mismatch may only surface at renewal or during an inspection.

Family dependants may also need their residence permits updated. The timing of the employee's change can affect the family's status, so coordinate the applications where possible.

Checklist

  • Check the current permit and residence permit expiry dates.
  • Confirm the new employer's ability to sponsor the role.
  • Review the contract for consistency with the permit application.
  • Prepare authenticated degree, criminal record and experience documents if required.
  • Diarise the residence permit update and the first tax filing.

Authorities apply the rules with local variations, and processing times change. A short call to the relevant window or a check of the current requirements before filing is usually worth the time.
